City Attorney Nicholas Toulet-Crump reported on community feedback regarding possible changes to the ordinance. Council does have the option to defer this item if they need time to review it since it is in its second reading.
Council Member Jack Ladd reported members of the judiciary have multiple concerns about this ordinance, such as how to enforce it, and would like to see it deferred.
Council Member Brian Stubbs agrees that the ordinance needs to be enacted but done right the first time.
Mayor Blong also agrees and wants to make sure it is done correctly. Discussion ensued among Council.

Planning Manager Landon Ochoa gave a brief overview of the item noting this is for the review of the Hot Shots bar (item originally approved in June 2025).
Council Member Jack Ladd inquired as to what constitutes an incident. Mr. Ochoa reported an incident is considered a call or report from the Police Department about the property. Council Member Ladd also inquired if there has been a reduction in incidents since the last time this item was on the agenda several months ago. Mr. Ochoa reported there are many ways the data can be gathered but he can not make that conclusion.
Council Member Brian Stubbs inquired about violence at the bar. Mr. Ochoa reported there have been a few assaults reported. Council Member Stubbs also inquired if the cameras and lights have been installed in the area.

The police report he received only shows nine incidents and two of those nine were on Sundays when his bar is closed. Mr. Chin reported his bar has taken a hit financially.

Patrick Cordero, 2909 West Wall Street, spoke for several individuals in favor of this item. Mr. Cordero passed out a communications report for the Hot Shots bar and other bars within Midland. Mr. Cordero pointed out the number of pages several bars have and reported it feels like Hot Shots is being singled out.

Mayor Blong reported she feels like the Hot Shots bar has done everything asked of them. Her concern is consistency and enforcement across the community.

City Manager Tommy Gonzalez gave a brief summary and history of this item and where we are currently.
Deputy City Manager Jose Ortiz provided a detailed report of how the agreement is set up.
Council Member John Burkholder requested that City Manager Tommy Gonzalez expound on audits regarding the drainage fees.
City Manager Tommy Gonzalez explained how the system is set up and why this action was chosen. Mr. Gonzalez also reported how Midland Independent School District (MISD) may potentially help out with this project and why this was the recommendation for the project.
Mayor Blong inquired of the total audited numbers for collections of property taxes and sales taxes for last year so that the community may understand what revenues come from each.
Chief Financial Officer Christy Weakland reported that the final sales tax number for the 2025 fiscal budget was 69.1 million and 62.5 million for property tax collections.
Mayor Blong reported why these funds are necessary and that the City has to find other mechanisms to pay for things citizens need. This is why the Airport and some other departments have become self-sustaining.
City Manager Tommy Gonzalez reported on the general fund budget numbers.
Marcus Oakley, 2432 Open Range, reported there is plenty of money in this area and is wondering why is this coming out of the pockets of citizens.
Council Member Burkholder used the Firemen’s Pension as an example of the City using other funds to help in times of need.
City Manager Tommy Gonzalez provided a report as to why we didn’t do a pension obligation bond.
Doug Aylor, 6408 Gladiola Avenue, spoke in opposition of this item, reporting this is due to a lack of planning.
Mayor Blong reiterated the Texas Penal Code 42.5 regarding disrupting meetings.
City Attorney Nicholas Toulet-Crump reiterated the rules the Council adopted regarding public comment. There is no provision in the rules to allow for a person to yield their time to another person.
Barbara Aylor, 6408 Gladiola Avenue, reported it is not clear to her why we need to do this and would like to know why can’t the money be found elsewhere.
Mayor Blong reported the city shows where the dollars go each year on the City of Midland’s website at www.midlandtexas.gov.

Nino Rodriquez, District 2, spoke in opposition of this item as businesses get tax abatements but citizens get taxed.
Andrew Sterns, 5614 Rio Grande Avenue, reported he agrees with Mr. Nino Rodriquez and spoke in opposition of this item. Mr. Sterns feels like the citizens are being deprived their right to vote.
